Heather Gay Settles $450,000 Federal Lawsuit Over Beauty Lab

Heather Gay and her Beauty Lab company settled a $450,000 federal lawsuit – following the dismissal of Monica Garcia’s suit against the same Real Housewives of Salt Lake City star.

In 2023, celebrity photographer Gavin O’Neill sued Heather and her Beauty Lab med spa for allegedly using images he captured of models. He accused the company of copyright infringement and demanded they pay $450,000 for damages.

Radar Online now obtained court docs showing that Heather and Beauty Lab reached a confidential settlement agreement with Gavin. According to the deal, all allegations against Heather and her med spa will be dismissed.

In last year’s suit, Gavin claimed they used the photos – without his permission – to promote their services.

“O’Neill is informed and believes Defendants (including their employees, agents, contractors or others over whom they have responsibility and control) used, displayed, published, and otherwise held out to the public O’Neill’s original and unique Photographs in order to acquire a direct financial benefit from the use of the Photographs through revenue from the sales of Beauty Lab’s products and services,” read the previous documents.

Heather’s filing responded, “Defendant’s infringement was not willful. Defendant removed the allegedly infringing photographs immediately upon receiving notice.”

Heather and Gavin’s deal to dismiss the lawsuit came on the heels of a judge dismissing Monica’s own lawsuit against Beauty Lab, which came after she claimed to have received “botched” injections. She filed the suit after Heather sued her for allegedly refusing to pay for services.
